These Terms of Service (“Terms”) govern your access to and use of SmilePro (“SmilePro”, “we”, “us”, or “our”), including our website, web application, software, AI-powered smile visualization tools, and related software features (collectively, the “Service”).
By creating an account, purchasing credits, subscribing to a plan, or otherwise using SmilePro, you agree to these Terms.
If you do not agree with these Terms, you must not use the Service.
1. About SmilePro
SmilePro is a software platform designed for dental professionals to create AI-assisted smile visualizations and presentation materials that can be used to communicate potential cosmetic outcomes with their patients.
SmilePro provides visualization and patient communication tools that may be used by dental professionals when discussing potential treatment options. SmilePro does not provide treatment plans and does not recommend dental procedures.
SmilePro is a software-as-a-service (SaaS) product. Customers purchase digital access to software features and AI processing. SmilePro does not provide dental, medical, diagnostic, or professional services.
All clinical decisions remain exclusively the responsibility of the licensed dental professional.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use SmilePro.
If you use SmilePro on behalf of a dental practice, clinic, company, or other organization, you represent that you have authority to accept these Terms on behalf of that organization.
3. Accounts
You may need to create an account to access certain features.
You are responsible for:
- providing accurate and current information;
- maintaining the confidentiality of your account credentials;
- maintaining the security of your account;
- all activity performed through your account; and
- notifying us promptly if you believe your account has been compromised.
You must not share your account credentials with unauthorized persons or use another person’s account without permission.
4. The SmilePro Service
SmilePro provides software tools that may allow users to:
- upload dental photographs;
- create AI-assisted smile visualizations;
- compare visual alternatives;
- save and manage cases;
- create patient presentation materials;
- organize visualization projects; and
- access other software features that we may introduce from time to time.
These tools are visualization and patient communication software. They may be used by dental professionals when discussing potential treatment options. They are not treatment plans, diagnoses, or recommendations of dental procedures.
Features may change, be added, or be discontinued as SmilePro evolves.
5. AI-Generated Visualizations
SmilePro uses artificial intelligence and automated image-processing technologies to generate visual simulations.
AI-generated results are visual representations only.
They are not guaranteed to accurately predict the outcome of any dental procedure or treatment.
The results may contain inaccuracies, artifacts, distortions, or other visual differences.
You acknowledge that AI-generated images must not be interpreted as:
- a diagnosis;
- medical or dental advice;
- a treatment prescription;
- a clinical recommendation;
- a guarantee of treatment results; or
- a substitute for professional clinical judgment.
All treatment decisions must be made by an appropriately licensed dental professional.
6. Professional Responsibility
SmilePro is intended primarily for use by dental professionals.
You are solely responsible for:
- evaluating the accuracy and appropriateness of any visualization;
- determining whether a proposed dental treatment is clinically appropriate;
- explaining limitations of visual simulations to patients;
- obtaining appropriate patient consent;
- complying with applicable professional regulations; and
- making all final clinical decisions.
SmilePro does not make clinical decisions on behalf of dentists or patients.
7. Patient Information and Photographs
If you upload photographs or information relating to patients, you represent and warrant that you have the appropriate legal basis, authorization, consent, or other lawful permission required to collect, use, and process that information through SmilePro.
You remain responsible for ensuring that your use of patient information complies with applicable privacy, healthcare, professional, and data-protection laws.
You must not upload information that you are not legally authorized to process.

8. Customer Content
You retain ownership of photographs, information, and other content that you upload to SmilePro (“Customer Content”).
You grant SmilePro a limited, non-exclusive, worldwide license to process Customer Content solely as necessary to:
- provide the Service;
- generate requested visualizations;
- store and display saved cases;
- maintain and secure the Service; and
- provide technical support.
We do not claim ownership of your Customer Content.
9. AI Training
Unless expressly stated otherwise in writing, SmilePro does not use Customer Content or patient photographs to train general-purpose artificial intelligence models.
Customer Content is processed for the purpose of providing the Service.
10. Intellectual Property
The SmilePro software, website, interface, branding, trademarks, logos, documentation, source code, designs, and underlying technology are owned by or licensed to SmilePro and are protected by applicable intellectual-property laws.
Except for the limited right to use the Service under these Terms, no rights to SmilePro’s intellectual property are transferred to you.
11. Prohibited Uses
You must not:
- use SmilePro for unlawful purposes;
- attempt to reverse engineer or decompile the software;
- circumvent security mechanisms;
- interfere with the operation of the Service;
- access accounts belonging to other users without authorization;
- upload malicious code;
- use automated systems to abuse the Service;
- resell or redistribute access without authorization;
- use SmilePro to provide medical or dental services on behalf of SmilePro;
- misrepresent AI-generated visualizations as guaranteed clinical outcomes; or
- use the Service in violation of applicable laws or professional regulations.
12. Payments and Credits
Certain SmilePro features require the purchase of credits or a paid subscription.
Prices are displayed before purchase.
Credits are associated with the account used to make the purchase and may only be used within SmilePro.
Unless otherwise stated, credits have no cash value and cannot be exchanged for cash.
We reserve the right to modify pricing in the future. Changes will not retroactively alter completed purchases.
13. Subscriptions
If you purchase a subscription, you authorize the applicable payment provider to charge the subscription fee according to the billing period selected at checkout.
You may cancel a subscription according to the cancellation options provided through your account or billing portal.
Cancellation generally prevents future renewals while allowing access through the applicable paid period, subject to the subscription terms and payment status.
Polar may process subscription billing and payments as the merchant of record for purchases made through its platform.
Polar’s payment and subscription systems may therefore apply additional terms to your transaction.
14. Refunds
Refund requests are handled according to our Refund Policy.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
15. Availability
We aim to keep SmilePro available and reliable, but we do not guarantee uninterrupted or error-free operation.
The Service may occasionally be unavailable due to:
- maintenance;
- updates;
- infrastructure failures;
- third-party services;
- security incidents;
- network problems; or
- circumstances beyond our reasonable control.
16. Third-Party Services
SmilePro may rely on third-party infrastructure, hosting, payment processors, AI processing providers, analytics providers, or other technology providers.
Third-party services may have their own terms and privacy policies.
We are not responsible for interruptions or failures caused exclusively by third-party services.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, SmilePro is provided on an “as is” and “as available” basis.
We do not warrant that:
- AI-generated visualizations will always be accurate;
- the Service will be uninterrupted;
- the Service will be error-free;
- visualizations will correspond to actual treatment outcomes; or
- the Service will satisfy every individual professional requirement.
18. Limitation of Liability
To the maximum extent permitted by applicable law, SmilePro and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
SmilePro is not responsible for clinical decisions, treatment decisions, patient outcomes, or professional advice provided by users.
19. Indemnification
You agree to defend, indemnify, and hold harmless SmilePro and its owners, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from:
- your misuse of the Service;
- your violation of these Terms;
- your violation of applicable law;
- your unauthorized processing of patient information; or
- your clinical or professional decisions.
20. Suspension and Termination
We may suspend or terminate accounts that violate these Terms, create security risks, engage in fraudulent activity, or misuse the Service.
You may stop using SmilePro at any time.
Upon termination, your right to access the Service may cease, subject to any applicable data-retention requirements and our Privacy Policy.
21. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we may provide reasonable notice through the Service or by email.
Your continued use of SmilePro after the effective date of updated Terms constitutes acceptance of the revised Terms.
22. Governing Law
These Terms shall be governed by the laws applicable to Global Technology, without prejudice to any mandatory consumer protections applicable in the user’s jurisdiction.
